The Longshore and Harbor Workers’ Compensation Act (LHWCA) was originally enacted in 1927 to provide benefits to injured workers in United States navigable waters in situations where no state workers compensation law applied. In 1984, Congress substantially amended the LHWCA to expand the protections to the longshoremen. The act’s coverage is clear with regard to the liability of the employer and the benefits an employee is entitled to receive in the event of an injury. In exchange for immunity from lawsuit, an employer must provide statutory benefits to an injured longshoreman without the need to prove the negligence of the employer.
Many times, however, longshoremen are injured in the course of working onboard a vessel or as a result of the negligence of some other party beyond their employer. To alleviate this concern, Congress enacted, 33 U.S.C. §905(b). Section 905(b) allows an injured longshoreman to sue the owner of a vessel for the vessel’s negligence in maritime tort with certain restriction. Additionally, 905(b) preserved the right of a longshoreman to sue in tort all non-employer/non-vessel parties as permitted by law.
