The inclusion of personal injury protection (PIP) in car insurance policies is required in the state of Florida. Personal injury protection, sometimes referred to as no-fault insurance, is designed to cover medical expenses and loss of wages without regard to legal liability. An update to Florida’s Personal Injury Protection Law took effect on January 1, 2008. The car accident attorneys of Downs Brill Whitehead have provided information about this update for the state’s residents.
If you would like to learn more, or if you need assistance in filing a PIP claim, contact Downs Brill Whitehead today. Our car accident attorneys serve residents from Broward, Miami, and surrounding communities. We represent medical care providers, such as doctors and diagnostic companies, as well as individuals who have been denied PIP benefits from insurance companies such as GEICO, State Farm, Allstate, United Automobile, Clarendon, MGA and U.S. Security
PIP provides you with financial compensation to cover medical expenses, loss of income, and death benefits stemming from injuries sustained in a car accident. Since PIP is required coverage in the state of Florida, all motorists are entitled to its benefits if they are involved in a car accident.
Although PIP covers up to 80 percent of the necessary applicable medical charges, policy limits are set at $10,000. These charges can include surgery, x-rays, dental work, and physical therapy. Disability benefit payments provided under PIP are paid every two weeks and cover 60 percent of lost wages, in addition to expenses related to housekeeping and other household services that you cannot perform due to your injury.
If you are related to or the executor or beneficiary of someone who has been killed in a car accident, PIP provides you with a monetary death benefit equal to the remaining unused compensation or $5,000, whichever is less.
If you have been injured in an auto accident and are having difficulty obtaining a fair settlement from your insurance company or the other driver’s insurance company, you should speak to the car accident attorneys at our Miami and Broward-area law firm as soon as possible. Do not sign any documentation without first consulting an attorney, or you could hurt your case. It is also important to file your claim in a timely manner. Statutes of limitation laws restrict the amount of time in which you can file a claim. Talk to a car accident attorney who is knowledgeable about Florida’s Personal Injury Protection Law to increase your chances of obtaining a favorable settlement.
